Welcome to Viter. These Terms of Service ("Terms") govern your access to and use of vitershop.com (the "Site") and any purchases you make from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

The Site is operated by Viter — Denys Hryniuk, a sole proprietorship registered in Poland, with its registered address at Synów Pułku 4/10, Warsaw, Poland ("Viter," "we," "us," or "our"). "Viter" is our brand name and is used as a trademark.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. By using the Site, you represent that you meet this requirement and that the information you provide is accurate, current, and complete.

3. Account

You may create an account to make checkout easier. You are responsible for:

Maintaining the confidentiality of your login credentials.
All activity that occurs under your account.
Notifying us immediately of any unauthorized use.

We may suspend or terminate accounts that violate these Terms or appear fraudulent.

4. Products and Pricing

We strive to display products and prices accurately, but errors can occur. Colors, dimensions, and product images are approximations and may vary slightly from the actual product.
All prices are listed in U.S. dollars (USD) unless otherwise stated.
Prices and product availability are subject to change without notice.
We reserve the right to limit quantities, refuse or cancel orders, and correct pricing errors — including after an order is placed. If we cancel an order for a pricing error, we will refund any amount you have paid.

5. Orders and Acceptance

Placing an order constitutes an offer to purchase. Your order is not accepted until we send an order confirmation. We may decline orders for reasons including but not limited to product unavailability, payment issues, suspected fraud, or shipping limitations.

6. Payment

We accept the payment methods displayed at checkout. By providing payment information, you represent that you are authorized to use the method and that the information is accurate. Payment is processed by third-party providers (such as Shopify Payments and PayPal); their terms and privacy policies apply to payment processing.

7. Shipping and Delivery

Shipping terms, processing times, and delivery estimates are described in our Shipping Policy (https://www.vitershop.com/policies/shipping-policy). Delivery dates are estimates and not guaranteed. Risk of loss passes to you once the carrier delivers the package to you, except where mandatory consumer protection law states otherwise.

8. Returns and Refunds

Returns and refunds are handled under our Return and Refund Policy (https://www.vitershop.com/policies/refund-policy), which is incorporated into and forms part of these Terms. Consumers in the EU have a statutory 14-day right of withdrawal, as set out in that Policy.

9. Promotions and Discounts

Promotions, discount codes, and special offers:

Are subject to their own terms posted at the time of the offer.
Cannot be combined unless expressly stated.
Have no cash value and are non-transferable.
May be modified or cancelled at any time.

10. Intellectual Property

All content on the Site — including text, graphics, logos, product photos, designs, the "Viter" name and logo, and the overall look and feel — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission, except for personal, non-commercial use of the Site.

11. User Content

If you submit reviews, comments, photos, or other content to the Site:

You grant us a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, modify, publish, and display that content in connection with our business and marketing.
You represent that you own or have the rights to the content and that it does not infringe any third party's rights.
You agree not to submit content that is unlawful, defamatory, obscene, threatening, infringing, or otherwise objectionable.
We may remove user content at our sole discretion.

14. Disclaimers

The Site and our products are provided "as is" and "as available" without warranties of any kind, express or implied, except where prohibited by applicable law, including mandatory consumer guarantees. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Our products are personal-care and beauty devices intended for cosmetic use only. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or skin condition. Consult a qualified healthcare professional before use if you have any skin condition, allergy, pregnancy, or other medical concern. Always follow the included instructions and safety warnings.

15. Limitation of Liability

To the maximum extent permitted by law, Viter, its affiliates, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from or related to your use of the Site or our products.

Our total liability for any claim related to the Site or a product purchase will not exceed the amount you paid for the product giving rise to the claim.

Nothing in this section limits our liability for death, personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law (including mandatory consumer protection law in Poland and the EU).

16. Indemnification

You agree to indemnify, defend, and hold harmless Viter from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site or products, or your violation of any law or third-party right.

17. Termination

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms. Sections that by their nature should survive termination will survive — including intellectual property, disclaimers, limitation of liability, and indemnification.

18. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved by the competent courts of Warsaw, Poland, except that where you are a consumer, mandatory consumer protection laws of your country of residence remain in effect, and you may also bring proceedings in the courts of your country of residence as permitted by EU consumer law.

19. Severability

If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, form the entire agreement between you and Viter regarding the Site and your purchases.

21. Changes

We may update these Terms from time to time. The "Effective Date" will reflect the most recent revision. Continued use of the Site after changes constitutes acceptance.
